The short version. SMARTLINK is free. Use it to fly, have fun and fly with friends. It comes as it is, with no promises, so back up anything you can't lose. Be decent in groups. Nothing in it is for real-world flying. Donations pay for the server and don't buy you anything. The full terms are below, and they are what count.

1. Who we are and what this covers

SMARTLINK is made by Kanzooie, in England, called "we" and "us" here. Who that is, and how to reach us, is in the Privacy notice. These terms cover the SMARTLINK app for Windows, its installer and updates, and the online services the app uses: the group flight relay, map data, feedback, shared cockpit controls and crash comparisons (together, "SMARTLINK").

By installing or using SMARTLINK you agree to these terms. If you don't agree, please don't use it, and uninstall it from Windows' Installed apps.

How we handle your data is set out in our Privacy notice.

2. Who can use it

SMARTLINK is meant for people aged 13 or over. If you're under 18, check with a parent or guardian before using the group flights or sending feedback.

3. Your licence to use it

We give you a free, personal, non-exclusive licence to install and use SMARTLINK on your own computers. You're welcome to share the download link with anyone. You may not:

SMARTLINK and its look, logo and name stay ours. Parts of it are other people's work, such as the map data, the speech model, fonts and code libraries, used under their own licences, which are listed in SMARTLINK under Settings.

4. Streaming, videos and screenshots

You're welcome to show SMARTLINK on streams, in videos and in screenshots, including its overlays and our logo as it appears in the app. You don't need to ask. Please don't suggest we sponsor or endorse your channel unless we've agreed it. Please keep the map's credits visible when you show a map.

5. It's free, and it comes as it is

SMARTLINK is a hobby project, offered free and "as is". We don't promise it will always work, always be available, be free of faults, or suit what you want it for. We may change, pause or stop any part of it, including the online services, at any time and without notice. Beta versions are tests and are more likely to have faults.

6. Your files and your sim

Some parts of SMARTLINK change things on your PC because you ask them to. The Hangar moves add-on folders into its library and makes links to them in your sim's Community folder. Routines can send keys and commands to the sim and start programs. VoiceLink sends keystrokes when it hears a phrase.

SMARTLINK is built never to delete your files. It tells you before it moves anything and keeps a journal so a move can be finished or undone. Even so, computers fail and so does software. Keep your own backups of anything you can't afford to lose, and check what a routine or phrase does before you rely on it in flight.

7. Not for real-world flying

Everything SMARTLINK shows is for flight simulation only. That includes weather, runways, routes, fuel figures, landing scores, airport and traffic information. It is not approved, checked or fit for planning or flying a real aircraft. Some of it comes from public sources that may be out of date or wrong.

8. Group flights and behaving well

When you join a WingLink group (SMARTLINK's group flights), the other pilots in it see your pilot name, your aircraft's position, height, speed and type, and your landings unless you turn sharing off. Please:

We can refuse names, end groups, and block an app from our services if we think it's needed to keep SMARTLINK working or to protect other people. A group's leader can see who joins their group and hand on the lead; other pilots can leave whenever they like.

Other pilots may record you. Anyone in a group can stream, film or screenshot what SMARTLINK shows them, including your pilot name, aircraft and landings. We can't control that, so don't treat a group flight as private.

Only SMARTLINK may connect to the relay. Please don't connect other software to it, or use it to collect other pilots' details.

9. Things you send us

When you send feedback, report an airport, share a cockpit control or compare a crash, you give us permission to keep it and use it to run and improve SMARTLINK, as set out in the Privacy notice. Shared cockpit controls may be offered to other pilots once enough installs agree. Please don't put personal details, passwords or anything you'd rather keep private into a feedback message.

If you send us an idea or suggestion, we may use it in SMARTLINK freely, without owing you anything or having to credit you, though we'll try to say thanks.

10. Other people's services

SMARTLINK works with services we don't run, such as SimBrief, the US Aviation Weather Center, adsb.lol, OpenStreetMap map data, Discord, add-on makers' and stores' websites, and Microsoft Flight Simulator itself. Their own terms apply when you use them, and we aren't responsible for them. Links to stores are for convenience: we don't sell anything and we take no cut of any sale.

SMARTLINK is not made by, endorsed by or connected with Microsoft, Asobo Studio or any add-on maker. Their names are used only to say what SMARTLINK works with.

11. Donations

Donations are voluntary gifts towards the server and its upkeep. They don't buy a product, a service, a feature, priority or any other benefit, and SMARTLINK works the same whether you donate or not. Donations aren't refundable, except where the law says they must be or a payment was taken by mistake. Contact us if that happens.

12. Our responsibility to you

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. If you're a consumer, you keep your legal rights.

Otherwise, because SMARTLINK is free, we're not responsible for any loss that comes from using it or not being able to use it, including lost files, add-ons or flights. Where we are responsible despite this, our total responsibility to you is limited to £50.

13. Stopping

You can stop using SMARTLINK at any time by uninstalling it. Your settings and logbook stay in your Windows profile until you delete them. We may stop offering SMARTLINK or block an app from our services, as section 8 says. Sections 5, 7, 9, 11 and 12, and the limits in section 3, still apply after you stop.

14. Changes to these terms

We may update these terms as SMARTLINK changes. The date at the top says when they last changed. We'll give at least 14 days' notice of an important change, in the app's What's new or in the SMARTLINK Discord, before it applies. For an important change, the app will ask you to agree again before you go back online. Carrying on using SMARTLINK after that means you accept the new terms; if you don't, you can stop using it.

15. The law

If something goes wrong, please contact us first so we can try to put it right.

These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you live in Scotland or Northern Ireland, you can also use your local courts.

These terms are the whole agreement between us about SMARTLINK. The Privacy notice explains how we use your data; it isn't part of this agreement. If any part can't be enforced, the rest still applies. If we don't enforce something straight away, we can still do so later. We may hand SMARTLINK and these terms on to someone who will keep it running; we'll tell you first, and your rights won't be reduced by it. You can't transfer your rights under these terms to someone else. Nobody else has any rights under these terms.
